These Terms of Service ("Terms") govern your use of NextrackRQ, a gamified song request and tipping platform for DJs. By accessing or using NextrackRQ, you agree to be bound by these Terms.

If you disagree with any part of these terms, you may not access the service.

Description of Service

NextrackRQ is a platform that enables:

• DJs to create events and manage song request queues
• Audience members to submit song requests and tips
• Real-time queue management and payment processing
• QR code generation for easy event access
• Analytics and reporting for event performance

User Accounts

Account Creation

To use certain features of NextrackRQ, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

Account Termination

We may terminate or suspend your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At your request

DJ Responsibilities

As a DJ using NextrackRQ, you agree to:

• Provide accurate event information
• Manage song requests fairly and responsibly
• Process tips and payments in accordance with our policies
• Comply with all applicable laws and regulations
• Respect audience privacy and data protection
• Maintain appropriate content standards

Audience Responsibilities

As an audience member using NextrackRQ, you agree to:

• Provide accurate information when submitting requests
• Respect the DJ's right to accept or decline requests
• Use appropriate language in messages
• Comply with event-specific rules and guidelines
• Understand that tips are non-refundable unless the request is skipped

Payment and Tipping

Tip Processing

• Tips are processed through Stripe payment processing
• Tips are held until the song is marked as "played"
• Refunds are automatically processed for skipped requests
• Payment processing fees apply as determined by Stripe

Disputes and Refunds

• Tip disputes must be resolved between the DJ and audience member
• We may mediate disputes but are not responsible for resolution
• Refunds are processed according to our refund policy

Content and Conduct

Prohibited Content

You may not submit content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Promotes spam, fraud, or deceptive practices
• Violates any applicable laws or regulations

Content Moderation

We reserve the right to:

• Remove or modify content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal activity to appropriate authorities

Intellectual Property

Our Rights

NextrackRQ and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Rights

You retain ownership of content you submit, but grant us a license to use, modify, and display it in connection with the service.

Privacy and Data Protection

Service Availability

We strive to maintain service availability but cannot guarantee:

• Uninterrupted or error-free service
• Immediate resolution of technical issues

• Service availability during maintenance periods

Limitation of Liability

To the maximum extent permitted by law, NextrackRQ shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from third-party actions
• Service interruptions or technical failures

Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
